Acceptance of these terms

These terms are an agreement between you and MALVIQ STUDIOS, a joint venture company registered in the Kingdom of Saudi Arabia, and they govern your use of the mobile games we publish. In these terms, "we", "us" and "our" mean MALVIQ STUDIOS, and "game" means any mobile game we publish.

By downloading, installing or playing one of our games you accept these terms. If you do not accept them, do not use the game, and uninstall it.

These terms apply to every game we publish. An individual game may have additional rules shown inside it, and where those conflict with these terms, the rules shown in the game apply to that game.

Who may use our games

Our games are intended for players aged 13 and over, and they are not directed at children. You may not use a game if you are under 13.

If you are 13 or over but under the age of majority where you live, or under the age at which you can agree to terms like these for yourself, you may use the game only with the agreement of a parent or guardian, who accepts these terms with you and is responsible for your use of the game and for any purchase made from your device.

You confirm that you are not barred from using our games under any applicable law or sanctions programme.

Your licence to use our games

We grant you a personal, limited, non exclusive, non transferable, revocable licence to install and play our games on a device you own or control, for your own personal and non commercial entertainment. That is all this licence gives you. We keep everything else.

You may not:

• copy, sell, rent, sublicense, lend or distribute a game or any part of it;
• modify, translate, adapt, decompile, disassemble or reverse engineer a game, or try to derive its source code, except to the extent the law expressly permits it and we cannot lawfully prevent it;
• remove, obscure or alter any notice of ownership or any of our marks;
• use a game commercially, including in a paid tournament or a paid streaming arrangement, without our written agreement;
• distribute a modified version of a game, or a tool whose purpose is to modify one.

This licence ends automatically if you break these terms. Nothing here transfers ownership of a game to you: you are licensed to play it, not sold a copy of it.

Acceptable use

You agree not to:

• cheat, or use a bot, script, modified client, emulator hack, memory editor or any other tool to gain an unfair advantage or to change how a game behaves;
• exploit a bug for gain rather than reporting it, or continue to exploit one after we have asked you to stop;
• interfere with a game's operation or with anyone else's use of it, or attempt to overload, probe or gain unauthorised access to any system we or our partners operate;
• obtain virtual currency or virtual items other than through the means the game provides, including through any fraudulent, cancelled or reversed payment;
• buy, sell, trade or transfer virtual currency, virtual items or game access for real money outside the game;
• interfere with the advertising in a game, including by blocking, faking or automating interactions with adverts;
• use a game for any unlawful purpose, or in breach of any applicable law.

If you find a security flaw, please tell us at the address in section 26 rather than exploiting or publishing it, and we will work with you.

Purchases

Our games are free to download. Some offer optional purchases, which may be one off purchases or subscriptions.

All payments are processed by Apple or by Google, not by us. They are the merchants of record. They collect your payment details, we never receive them, and your purchase is also subject to their terms.

Before you buy, the game and the store payment screen show you what you are buying and the price. The price shown in the game will match the price shown in the store's own payment interface. Prices vary by country and may change, and we will not change the price of something you have already bought.

Refunds

Because Apple and Google take the payment, refunds are theirs to grant, not ours. We cannot issue a refund on their behalf, and we will not promise one we cannot deliver. Request a refund through the store you bought from. Our support page explains where.

We will help. If you were charged and the item never arrived in the game, that is a delivery problem rather than a refund question, and we will fix it or help you obtain a refund from the store.

Nothing in this section affects any right to cancel or to a refund that the law of your country gives you and that cannot be excluded by agreement.

Subscriptions

Where a game offers a subscription, these terms apply to it.

• The game tells you, before you buy, what the subscription includes, how long each period lasts, and the full price for that period.
• Subscriptions renew automatically at the end of each period, and you are charged for the next period, until you cancel.
• You cancel through the store, not through us. On iOS and iPadOS, in Settings under your Apple Account, then Subscriptions. On Android, in the Google Play app under Payments and subscriptions, then Subscriptions. Cancelling stops the next renewal; it does not shorten the period you have already paid for.
• Cancellation must be made before the renewal date. Exactly how long before is set by the store, not by us.
• If a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before then.
• If we change the price, the store will notify you and ask for your agreement before charging the new price, as its rules require.
• If a payment fails or you cancel, the benefits of the subscription stop at the end of the period already paid for.

Virtual currency and virtual items

Games may include virtual currency, such as coins or gems, and virtual items, such as characters, upgrades or cosmetics. These matter enough to be precise about.

• You do not own virtual currency or virtual items. You receive a limited, personal, non transferable, revocable licence to use them inside the game they belong to.
• Virtual currency you have purchased does not expire.
• They have no monetary value. They are not money, credit, or a balance you hold with us, and they cannot be redeemed for cash or anything outside the game.
• They cannot be transferred, sold, traded or gifted outside the game, and they do not move between our games or between platforms unless a game says otherwise.
• They are not your property and do not pass to anyone else, including on death or as part of any legal process.
• We may change, rebalance or withdraw a virtual item, or change what it costs or what it does, as part of the normal development of a game.
• We may remove virtual currency or items obtained in breach of these terms, including through a cheat, a bug, or a payment that was reversed or charged back.

Nothing here limits any right you have under the consumer law of your country that cannot be excluded by agreement.

Restoring purchases

Purchases that can be restored, including subscriptions and permanent unlocks, can be restored to a new device or after reinstalling, using the "Restore Purchases" option in the game's settings. You will need to be signed in to the same Apple Account or Google account you bought with.

Consumable purchases, such as a pack of coins you have already spent, cannot be restored, because they have been used.

Because our games have no accounts, your purchases are tied to your store account. If you use a different store account, or a different platform, your purchases will not appear.

Randomised items

Where a game offers a paid item that gives a randomised reward, the game discloses the chance of receiving each type of reward before you buy, on or immediately next to the purchase screen.

Advertising

Our games are funded by advertising, and you will see adverts. Some are optional and shown in exchange for a reward, and some are shown between parts of the game.

Adverts come from third party advertising networks, not from us. We do not choose, write or endorse them, and we are not responsible for the products or services they promote, or for what happens on a website or in an app you reach by tapping one.

How advertising uses data, and how to change your choices about it, is explained in our Privacy Policy. You can decline personalised advertising and keep playing.

Where a game offers a purchase that removes adverts, what it removes is described at the point of purchase.

Availability, updates and discontinuation

We provide our games as a service, and we do not promise that a game will always be available, uninterrupted or free of faults. Availability may be affected by maintenance, by your device, by your network, or by the app stores.

We may update a game, and updates may add, change or remove features. Your device or operating system version may eventually stop being supported.

We may discontinue a game. If we withdraw a game permanently we will give reasonable notice inside the game or on this website where we are able to, we will stop selling virtual currency and items in it before it closes, and we will handle any unused paid virtual currency in accordance with the law that applies to you. Virtual currency and items exist only inside the game they belong to, so they do not survive its closure.

Intellectual property

The games, and everything in them, including code, artwork, characters, audio, music, text and design, are owned by us or by our licensors and are protected by copyright, trade mark and other laws.

MALVIQ and MALVIQ STUDIOS, and our logo, are our marks. You may not use them without our written permission, except to refer to us fairly and accurately.

You may record and stream your own gameplay, and share it on video and streaming platforms, including where that channel is monetised by the platform's normal advertising or subscription arrangements, provided you do not present it as official, do not use our marks as your own, and do not sell the footage itself. We may withdraw this permission if it is misused.

If you send us an idea, a suggestion or feedback, you agree we may use it without obligation or payment to you. Please do not send us anything you consider confidential.

If you believe something in a game infringes your rights, write to us at the address in section 26 with enough detail to identify the work and the alleged infringement.

App stores and other third party services

Our games are distributed through the Apple App Store and Google Play, and they include software from other companies for advertising, analytics, crash reporting and purchase validation. Those companies are named in our Privacy Policy.

You must comply with the applicable third party terms of agreement when using our games. That includes the terms of the store you downloaded from and, where relevant, your network operator's terms.

We are not responsible for third party services, for their content, or for their availability, and their terms and privacy policies apply to them rather than ours.

Additional terms for the Apple App Store

This section applies if you obtained the game from the Apple App Store, and prevails over anything inconsistent elsewhere in these terms in that case.

1. Acknowledgement. You and we acknowledge that these terms are concluded between you and us only, and not with Apple. Apple is not responsible for the game or its content.
2. Scope of licence. The licence granted to you for the game is limited to a non transferable licence to use the game on any Apple branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Maintenance and support. We are solely responsible for providing any maintenance and support for the game. Apple has no obligation to furnish any maintenance and support services for it.
4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the game to you if any; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the game.
5. Product claims. We, and not Apple, are responsible for addressing any claims by you or any third party relating to the game or your possession or use of it, including product liability claims, any claim that the game fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
6. Intellectual property rights. We, and not Apple, are solely responsible for the investigation, defence, settlement and discharge of any third party claim that the game or your possession and use of it infringes that third party's intellectual property rights.
7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a United States Government embargo, or that has been designated by the United States Government as a terrorist supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.
8. Our name and address. Our name, address, and the contact information to which any questions, complaints or claims should be directed, are set out in section 26.
9. Third party terms. You must comply with applicable third party terms of agreement when using the game.
10. Third party beneficiary. Apple, and Apple's subsidiaries, are third party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these terms against you as a third party beneficiary.

Additional terms for Google Play

This section applies if you obtained the game from Google Play. Your use of the game is also subject to the Google Play Terms of Service, and where these terms conflict with Google's Developer Distribution Agreement, that agreement prevails.

Google is not a party to these terms and is not responsible for the game. Purchases and refunds are handled by Google under its own terms.

Privacy

Our Privacy Policy explains what data our games collect, who receives it, and the choices and rights you have. It forms part of your agreement with us, so please read it.

Support

We provide support for our games ourselves. Our support page explains how to reach us and what to include so we can help quickly. Apple and Google have no obligation to support our games.

Suspension and termination

You may stop using a game at any time by uninstalling it. That ends this agreement for that game, except for the sections that are intended to survive it.

We may suspend or end your access to a game, or remove virtual currency or items, if you breach these terms, if you cheat or defraud us, or if we are required to by law. Where it is reasonable and lawful to do so we will tell you why, and where the breach can be put right we will give you the opportunity to do so first.

If we end your access because you broke these terms, you are not entitled to a refund of anything you have bought, except where the law of your country requires one.

Disclaimer of warranties

To the fullest extent permitted by law, our games are provided "as is" and "as available", without warranty of any kind. We do not warrant that a game will be uninterrupted, error free, secure, or free of harmful components, or that it will meet your expectations or work on every device.

Nothing in this section excludes or limits any warranty or right that the law of your country gives you and that cannot be excluded or limited by agreement. In particular, if you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer guarantees, those guarantees still apply.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, for loss of profit, revenue, data, goodwill or virtual items, or for any loss that was not reasonably foreseeable when you accepted these terms.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

Indemnity

You agree to indemnify us against any claim, loss or reasonable cost arising from your breach of these terms or your unlawful use of a game. This does not apply to the extent the claim arises from something we did wrong, and it does not apply where you are a consumer and the law of your country does not permit it.

Governing law

These terms, and any dispute arising out of them or out of your use of our games, are governed by the laws of the Kingdom of Saudi Arabia.

This does not take away your consumer rights. If you are a consumer, you keep the benefit of any mandatory protection given to you by the law of the country where you live, and you may bring proceedings in the courts of that country where the law gives you that right.

Disputes

If you have a problem, please contact us first at the address in section 26. Most things are resolved that way, and we would rather fix it than argue about it.

General

Severability

If any part of these terms is found to be unenforceable, the rest continues to apply, and the unenforceable part is treated as modified to the minimum extent needed to make it enforceable, or removed if that is not possible.

Entire agreement

These terms, together with our Privacy Policy and any rules shown inside a game, are the whole agreement between you and us about our games, and replace any earlier understanding about them.

No waiver

If we do not enforce a right straight away, we do not lose it.

Assignment

You may not transfer your rights under these terms. We may transfer ours to a company that takes over the relevant business, provided your rights are not reduced.

Events outside our control

We are not liable for a failure to perform caused by something outside our reasonable control, including network or platform outages, acts of government, or natural events.

Language

These terms are written in English. Where we provide a translation, it is for convenience.

Changes to these terms

We may change these terms, for example when we add a feature or when the law changes. The date at the top of this page records the most recent revision.

If a change materially affects your rights we will give you notice inside the game or on this website before it takes effect. Continuing to play after a change takes effect means you accept the new terms. If you do not accept them, uninstall the game.

A change will not apply retrospectively to a purchase you have already made.
